Joshua Hart, doing business as Hartistic ("we," "us," or "our"), operates the Next Batter Up mobile application (the "App"). This Privacy Policy describes how we collect, use, disclose, and protect your information when you download, install, or use the App. By using the App, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the App.
1.1 Information You Provide
You may enter player names, team names, jersey numbers, lineup configurations, and other team-related content into the App. This data is stored locally on your device using iOS's Core Data framework and, if you choose, backed up to your personal iCloud account (see Section 4).
1.2 Audio Recordings
If you choose to record custom voice announcements, the App will request access to your device's microphone. These recordings are stored locally on your device and are never uploaded to our servers.
1.3 Photos
The App may request access to your photo library so you can add photos for teams. These images are stored locally on your device and are not transmitted to us.
1.4 Apple Music Data
The App requests access to your Apple Music library solely to allow you to select and play walk-up songs. We do not store, collect, transmit, or have access to your Apple Music library contents, listening history, or subscription status.
1.5 Support Communications
The App includes an in-app "Contact Support" feature that opens an iMessage (SMS) conversation. If you use this feature, your phone number will be visible to us as part of the iMessage conversation. We use this information solely to respond to your support inquiry and do not store, sell, share, or use your phone number for any other purpose, including marketing.
1.6 AI Voice Announcements
The App offers AI-generated voice announcements powered by a third-party text-to-speech service (ElevenLabs). When you use this feature, the text you enter for a player's announcement is sent to ElevenLabs' servers to generate the audio. This text typically includes the player's name and any custom announcement text you provide. The generated audio is then stored locally on your device. We do not control ElevenLabs' data practices; please refer to ElevenLabs' Privacy Policy for more information on how they handle data.
1.7 Automatically Collected Information
We do not operate analytics servers or use third-party analytics SDKs. Apple may collect anonymous, aggregated usage data (such as app launches, crashes, and device type) through its built-in App Analytics service. This data is collected and controlled by Apple, not by us, and cannot be used to personally identify you. For more information, see Apple's Privacy Policy.

If you contact us via email for support, we use your email address only to respond to your inquiry. We do not add it to any mailing list or share it with third parties.
We do not sell, rent, trade, or otherwise disclose your personal information to any third party for marketing or advertising purposes.
Your data may be shared in the following limited circumstances:
Local Storage: All user-created data (player names, team names, lineups, audio recordings, and music selections) is stored on your device using iOS's Core Data framework and standard on-device storage mechanisms.
iCloud Backup: The App offers optional iCloud backup and restore functionality. When enabled, your team data is stored in your personal iCloud account using Apple's CloudKit/CloudDocuments framework. This data is encrypted in transit and at rest by Apple and is associated with your personal Apple ID. We do not have access to your iCloud data. Your use of iCloud is governed by Apple's iCloud Terms of Service and Apple's Privacy Policy.
Retention: Your local data persists on your device for as long as the App is installed. Deleting the App permanently removes all locally stored data from your device. iCloud backups can be managed through your device's iCloud settings.
Security: Your locally stored data is protected by your device's built-in security features, including device passcode, Face ID, Touch ID, and iOS data encryption. We recommend keeping your device software up to date to maintain the highest level of security.

You may revoke any of these permissions at any time through your device's Settings app. Revoking permissions may limit certain features of the App.

We do not integrate any third-party advertising networks, analytics SDKs, social media SDKs, or tracking tools.
The App is rated 4+ on the App Store and is intended for use by coaches, parents, and other adults to manage lineups for baseball and softball teams, which may include children under 13.
We are committed to complying with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13. The App is designed to be operated by adults (coaches and parents), not by children directly.
Player names and other team data entered into the App are stored locally on the user's device and are not transmitted to our servers. When AI voice announcements are generated, the player name included in the announcement text is sent to ElevenLabs for audio generation. We recommend that coaches and parents exercise discretion when entering information about minors.
Because we do not collect personal information on our servers, there is no personal information of a child for a parent to review, delete, or restrict through us. Parents and guardians can manage all data directly within the App or by deleting the App. If a parent or guardian has concerns, they may contact us at the email address below.
8.1 California Residents (CCPA/CPRA)
Under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), California residents have the right to know what personal information is collected, to delete personal information, to opt out of the sale or sharing of personal information, and to not be discriminated against for exercising these rights.
We do not sell or share personal information as defined by the CCPA/CPRA. The only personal information that may be transmitted from the App is announcement text sent to ElevenLabs for AI voice generation, which is used solely to provide the requested service and is not sold or shared for any other purpose. 8.2 European Economic Area, United Kingdom & Switzerland (GDPR/UK GDPR)
If you are located in the EEA, UK, or Switzerland, you have rights under the General Data Protection Regulation (GDPR) including the right of access, rectification, erasure, data portability, restriction of processing, and the right to object to processing.
The App processes nearly all data locally on your device. For AI voice announcements, the legal basis for sending announcement text to ElevenLabs is your explicit consent (you initiate each request). You have full control over your data on your device at all times. You may delete all data by uninstalling the App.

The App does not track you across other apps or websites. We do not respond to Do Not Track (DNT) signals because we do not engage in any tracking. We do not use Apple's App Tracking Transparency framework because we do not track users.
Most data is stored locally on your device with no international transfer. When you use AI voice announcements, announcement text is sent to ElevenLabs, which may process data on servers located in the United States or other jurisdictions. iCloud data is managed by Apple in accordance with Apple's data handling practices. No other data is transferred to our servers or any third-party servers.
We may update this Privacy Policy from time to time. When we make changes, we will update the "Last updated" date at the top of this page. If we make material changes that affect how we handle personal information, we will provide notice through the App or by other appropriate means. Your continued use of the App after any changes constitutes your acceptance of the updated Privacy Policy.
